Welcome to Collect Fumos! These Terms of Service (the "Terms") govern your access to and use of the Collect Fumos! Discord bot ("the Bot" or "our Service"). By using the Bot, you explicitly agree to be bound by these Terms, as well as our Privacy Policy and Discord's Terms of Service and Community Guidelines. If you do not agree with any part of these Terms, you may discontinue use of the Bot immediately.
1. Eligibility
To use Collect Fumos!, you must:
Have a valid Discord account.
Be 13 years of age or older (or the minimum age in your country to use Discord).
Comply with Discord’s Terms of Service and Community Guidelines.
2. Acceptable Use
You agree to use the Bot only for lawful purposes and in a way that does not interfere with others’ enjoyment or the integrity of the game and its community. Specifically, you must not:
Spamming and Abuse: Engage in excessive command usage, "bot farming" (using multiple accounts to manipulate features), or any other activity that constitutes spam, disrupts the Bot's service, or negatively impacts other users' experience.
Exploitation: Intentionally exploit any bugs, glitches, errors, or unintended features within the Bot to gain an unfair advantage, disrupt its operation, or bypass intended limitations.
Cheating and Manipulation: Attempt to manipulate or artificially inflate in-game statistics, currency balances, Fumo acquisition rates, or leaderboard rankings through unauthorized means, including but not limited to using multiple Discord accounts (alt accounts) to bypass cooldowns, gain extra rewards, or otherwise subvert fair play. This also prohibits the use of any unauthorized third-party software, scripts, or automation tools ("bots" or "macros") to interact with our Bot.
Inappropriate Content: Upload, submit, or link any content (e.g., Fumo submissions, images for custom Fumos, Fumo names) that is illegal, inappropriate, explicit (NSFW - Not Safe For Work), racist, offensive, discriminatory, harassing, or otherwise violates Discord's Community Guidelines.
Violation of these rules may result in immediate and severe action, including:
A formal warning.
Temporary or permanent restriction, suspension, or blacklisting from using the Bot and its features.
Reversal of any ill-gotten gains, such as illegally acquired Fumos, currency, achievements, or manipulated stats.
Reporting your conduct to Discord Trust & Safety in severe or repeat cases.
3. Ownership and User Submissions
All intellectual property rights in the Bot itself, including its core features, underlying code, artwork (excluding user-submitted), and all other content created and maintained by the developers, remain with the bot developers.
However, Collect Fumos! actively encourages and allows users to contribute their own content ("User Submissions"), including custom Fumo designs, artwork, image links, and Fumo names.
By submitting any content, you affirm and warrant that:
You are the original creator and owner of the content, or you have obtained all necessary rights, licenses, and permissions to use, share, and grant the licenses set forth herein.
Your User Submission does not infringe upon the copyrights, trademarks, privacy rights, publicity rights, or any other intellectual property or proprietary rights of any third party.
You grant the bot owner a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Submissions in connection with the Bot's operation, promotion, and further development. This comprehensive license includes, but is not limited to, displaying your submitted content within the Bot, on associated websites, or in promotional and marketing materials.
We reserve the right, at our sole discretion, to review, accept, modify, reject, or remove any User Submission at any time for any reason, with or without explanation.
4. Availability, Updates, and Data Integrity
The Bot is provided on an "AS IS" and "AS AVAILABLE" basis. While we diligently strive for high availability, stable performance, and reliable service, we cannot guarantee uninterrupted access. The Bot may go offline temporarily for scheduled maintenance, necessary updates, or due to unforeseen technical issues, including those beyond our control.
Features, in-game content (such as Fumo types and rarities), core game mechanics, rewards, and economic balances within the Bot may be added, removed, changed, or rebalanced at any time without prior notice.
We are not responsible for any direct or indirect loss of data, in-game progress, Fumos, currency, rewards, or any other virtual items you may possess within the Bot. This includes losses incurred due to bot errors, technical failures, routine maintenance, accidental deletions, or malicious third-party actions. Your use of the Bot and your reliance on its data is at your sole risk.
5. User-Generated Content and Copyright
Collect Fumos! makes use of user-submitted content, including images, names, and fan art, to enrich the game experience. While we make a diligent effort to moderate all submissions and ensure compliance with our terms, we cannot guarantee that all user-submitted content is entirely free of copyright restrictions or intellectual property infringements.
If you are a legitimate rights holder and believe your copyrighted material has been used within the Bot without your permission, you may request its removal. We are committed to promptly complying with all valid takedown requests.

Note: We do not claim ownership over existing characters, brands, or images submitted by users that originated from external intellectual property. All rights to such original content remain with their respective creators.
6. Intellectual Property of Third Parties
Collect Fumos! is a fan-made project created by enthusiasts for enthusiasts. It utilizes images and likenesses of "Fumo" plush toys, which are intellectual property (IP) primarily associated with companies such as Gift-Gift.jp and other authorized manufacturers.
No Claim of Ownership: We do not claim any ownership over these original Fumo designs, their associated brands, or any other third-party intellectual property displayed or referenced within the Bot. All rights to such IP remain with their respective copyright and trademark holders.
Fan-Made Nature: The Bot is a non-commercial (though it may accept donations to cover operational costs), fan-created tribute and game. Its use of these images is intended for transformative and recreational fan purposes within the context of a game, not to create or sell counterfeit merchandise or directly compete with official products.
No License Granted: Your use of the Bot does not grant you any license or rights to use the third-party Fumo IP.
Takedown Policy: We respect the intellectual property rights of others. If you are a copyright or trademark holder and believe that any content within our Bot infringes upon your rights, please refer to our "User-Generated Content and Copyright" section (Section 5) for our contact information and takedown request procedure. We are committed to promptly addressing valid requests.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall [Your Name/Entity Name - e.g., Yukio], its affiliates, directors, employees, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Bot; (ii) any conduct or content of any third party on the Bot; (iii) any content obtained from the Bot; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
8. Disclaimer of Warranties
Your use of the Bot is at your sole risk. The Bot is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Yukio, its subsidiaries, affiliates, and its licensors do not warrant that:
a) The Bot will function uninterrupted, securely, or be available at any particular time or location; b) Any errors or defects will be corrected; c) The Bot is free of viruses or other harmful components; or d) The results of using the Bot will meet your specific requirements.
9. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time, we will make reasonable efforts to provide a notice within our official channels (official discord server) before any new terms take effect, but we cannot guarantee. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Bot.
10. Termination
We reserve the right to terminate or restrict your access to the Bot at any time, with or without notice, if you violate these Terms or engage in any conduct that is disruptive, malicious, or detrimental to the Bot, its users, or Discord's platform.
